Abstract

In general, inheritance is distributed equally without distinction between men and women, as is the case in Blumbang Village, Tawangmangu District, Karanganyar Regency. This system is based on bilateral kinship patterns and mutual agreements to avoid social jealousy and potential disputes in the future. This study aims to examine this practice using empirical legal methods through field research with a qualitative approach. The results show that inheritance is distributed equally according to local customs, but children who care for their parents usually receive a larger share as a form of appreciation. From an Islamic legal perspective, this practice can be categorized as a gift because the gift is given while the testator is still alive, and gifts do not have standard distribution provisions.
