Urgensi Kepemilikan Sertifikat Halal Bagi UMK Berdasarkan UU No. 33 Tahun 2014 Tentang Jaminan Produk Halal Perspektif Mashlahah Mursalah

Abstract

Article 4 of Law No. 33 of 2014 concerning Halal Product Guarantee states that products circulating in the market in the territory of Indonesia must be verified as halal, as well as MSE products. The method used by the author in this study uses a normative legal approach with a descriptive analytical research type to look at the technical aspects of Micro and Small Enterprises that have not yet obtained halal certificates and a benefit study looking at the halal obligation regulations. The conclusion is that self-declaration in the Job Creation Law policy provides convenience for MSE actors. According to the Fourth Dictum letter (k) of the Decree of the Head of BPJPH No. 33 of 2022 concerning not containing elements of slaughtered animals in its function, ma?lahah mu'tabarah has been achieved, namely benefits supported by sharia, which are the main points of the daruri nature of maqa?id al-shari'ah, namely; preserving religion, preserving life, preserving reason, preserving offspring, and preserving property. It is hoped that the government will also provide convenience for MSME business actors who use animal ingredients, to protect all Muslim consumers in consuming halal and ?ayyib food from the smallest sector.
